Guest Wi-Fi Terms and Conditions

This agreement outlines the terms and conditions for accessing the wireless internet service (“the Service”) provided by Dawn Mountains, including any parent or partner companies (“us”). By using the Service, you agree to these terms and conditions and consent to receive promotional and marketing material via email.

1. Scope and Use of the Service

1.1. The use of websites or other internet services (“Internet Services”) via the Service is entirely at your own risk.

1.2. We are not responsible for, nor do we endorse or guarantee, the content or functionality of the Internet Services you access.

1.3. We do not monitor or control the information you send or receive using the Service, except for network diagnostics.

1.4. The Service is provided “as is,” and we do not guarantee:

• The availability or uninterrupted operation of the Service.
• The speed of data transmission or download/upload capabilities.
• Compatibility of the Service with your device(s) or software.

8.1.1. Your Use of the Service

By using the Service, you agree not to use it for accessing Internet Services, sending emails, or receiving communications that:

1. Are defamatory, threatening, or intimidating, or could be considered harassment.
2. Contain obscene, profane, or abusive language or material.
3. Include pornographic content, such as text, images, videos, or clips of a sexually explicit or arousing nature.
4. Feature offensive or derogatory material related to sex, race, religion, color, origin, age, disability (physical or mental), medical condition, or sexual orientation.
5. Infringe third-party rights, including intellectual property rights.
6. In our reasonable opinion, negatively impact our operations or reputation.
7. Are otherwise unlawful, unethical, or inappropriate.

Respecting Copyright

• Internet content such as music, videos, images, and text may be protected by copyright. You must not download, modify, email, or use such content without clear authorization from the copyright owner.
• If we reasonably believe you are in breach of any of the above provisions (8.1.1 to 8.1.7), we may suspend or terminate your access to the Service.

Confidentiality and Risk

• We recommend you avoid transmitting or receiving confidential information using the Service. If you choose to do so, you do so entirely at your own risk.
• The Service is intended for consumer use only. If you use it for commercial purposes, additional terms (e.g., clause 12.2) may apply.

10. Criminal Activity

10.1. You must not use the Service to engage in activities that are, or could be considered, a criminal offence, either in South Africa or elsewhere.

10.2. You acknowledge that we may be required to assist and provide information to law enforcement, governmental bodies, or other authorities.

10.3. We may log and retain the following information for investigative purposes:

• Internet Protocol (IP) addresses of devices accessing the Service.
• Access times for those devices.
• Associated online activities.

10.4. You agree that we are entitled to cooperate with law enforcement authorities and rights-holders in investigating suspected illegal activity. This may include:

• Sharing information outlined in clause 10.3.
• Disclosing additional data, as legally required, to law enforcement agencies or rights-holders.

By using this Service, you accept full responsibility for complying with these terms. Non-compliance may result in suspension or termination of access and further legal action if necessary.
